This Privacy Statement contains information about the processing of your personal data via the websites www.upstairs.com and www.upstairs.nl of Escada B.V., which also trades under the names of Upstairs and Upstairs Traprenovatie (“Upstairs”). Upstairs is responsible for the processing of your personal data.

Protecting your personal data is very important for Upstairs. We understand that you want to have your personal data and privacy protected. We will always process your personal data in accordance with the prevailing legislations, including the General Data Protection Regulation and the Netherlands Telecommunications Act. This statement provides details of the way in which we gather your personal data, the purposes for which we gather it and what your data will be used for.

Your personal data

We shall not process your personal data for any purposes other than those that are set out in this Privacy Statement. In addition, your personal data will not be stored for longer than is necessary for these purposes, unless we are obliged under law to store it for longer or to process it further.

Requesting information

On our website you can use our contact form to request information about Upstairs and the various options for new stairs. We request that you enter your name, postcode, telephone number and e-mail address. Entering your postcode will help us when sorting and clustering specific contact requests. We will send you an e-mail to confirm your information request, after which we will contact you by telephone in order that we can provide you with the best possible service. After you have completed this contact form we will delete your personal data within a maximum of 12 months.

Newsletter

You can opt to receive exclusive offers and newsletters by e-mail. We ask you to provide us with your e-mail address in order for you to receive these newsletters. If you have opted to receive details of special offers from Upstairs you can unsubscribe at any time by clicking on the unsubscribe link at the bottom of each e-mail or by sending an e-mail to this effect to info@upstairs.com. After you have unsubscribed we will delete your e-mail address as quickly as possible, within a maximum of two weeks.

Stair renovation

If you have expressed an interest in a stair renovation by Upstairs, we will request your name, address, telephone number and e-mail address insofar as you have not already provided these when requesting information via our contact form. This information is necessary so we can discuss the options with you in your home, provide you with customised advice and a quote, and to be able to actually undertake the subsequent renovation of your stairs. In connection with our guarantee we will store the necessary customer details for the 10-year guarantee period after your stairs have been fitted.

Reviews

If you have instructed Upstairs to renovate your stairs for you we may send you an invitation to provide a review of our service and products, for which we will use your name and e-mail address. There is no obligation to provide a review.

Working at Upstairs

Via our website you can use the relevant forms to apply for vacancies at Upstairs or at our sister company Van Dijk Postforming & Vlakverlijming B.V. The information you provide will only be used for recruitment and selection purposes so we can assess whether you are suitable for the vacant position. We request that you enter your first and last names, your telephone number and e-mail address and that you upload your CV. You can also add your letter of application to the application form or add comments. After the applications procedure has been completed your data will be deleted within four weeks unless you give permission for your data to be stored for up to one year after the procedure has ended.

Telephone customer service

When you call our client service line we may retain information about this contact moment, for example by recording your comment, question or complaint, so that we can be of service to you again at a later stage. We may also record your telephone call with our client service staff. You will be informed about this at the time of your call and before the recording commences. The recordings are used for training purposes and as proof of contract formation or other agreements made. The calls are deleted once they are no longer needed for these purposes.

We shall request your prior permission for the processing of your personal data, unless the data is required for the performance of a contract or we are obliged to process it under law or if we have a legitimate interest in doing so. If you grant permission for the processing, you have the right to withdraw that permission at any time. The data processing that was solely based on your permission will then be stopped. However the withdrawal shall not affect the legitimacy of the processing based on the permission granted prior to the withdrawal of the permission or based on a legitimate interest.

The websites of Upstairs use cookies. Cookies are small data files that are stored on the hard drive of your device by your browser or application and which are read out by your browser. We use cookies for the operation of our website, for measuring the effectiveness of our website and for marketing purposes.

You also have the right to restrict our processing of your personal data or to object to our processing of your personal data. You can also request us to transfer your personal data to you.

With regard to the processing of your personal data by Upstairs you therefore have the right:

  • to obtain a definitive answer about whether or not your personal data is being processed, and, if that is the case, you have the right to inspect your personal data and other relevant information;
  • to request the rectification of incorrect personal data or to request the supplementing of incomplete personal data;
  • to have your personal data deleted if the data is no longer needed, if you have withdrawn your permission for its processing and, provided there are no other legal grounds for the processing, if you have – justifiably – objected to the processing and/or if your personal data has been processed illegally;
  • to limit the processing if it is uncertain whether your personal data is correct, if your personal data has been processed illegally, if your personal data is no longer necessary for Upstairs but you require it for a legal claim, and/or if you have objected to the processing and this objection is still being assessed;
  • to obtain your personal data in a structured electronic format and to have it transferred to another party, directly if required.

You will receive a response to your request within a maximum of one month. If you do not agree with the content of this response, the rejection of your request or with the processing of your data by Upstairs otherwise, then you always have the right to submit a complaint to the Dutch Data Protection Authority.

Third parties

We will share your personal data with third parties in specific cases, provided this is explicitly stated in this Privacy Statement or if this is required under law or by a competent authority.

We use MailChimp for sending out our newsletters. For this purpose, we only provide this party with your e-mail address. In addition, we occasionally use the services of Trustpilot for gathering reviews about our service and products. We provide this party with your name and e-mail address if you are invited to write a review.

Some parties are based outside of the European Union. In that case, the forwarding of your personal data is based on an Adequacy Decision of the European Commission or – for parties based in the United States of America – certification for the EU-US Privacy Shield. If that is not the case then Upstairs has implemented appropriate and suitable guarantees with these parties. You can obtain a copy of these guarantees at any time by sending an e-mail to info@upstairs.com.

Protecting your data

We shall take appropriate measures to ensure that your personal data is processed in line with prevailing legislation and that it is protected against unauthorised and unlawful processing, loss, destruction or corruption for example. Our website therefore uses an encrypted connection (HTTPS) so that the data you send is encrypted and protected.

Upstairs retains the right to amend the Privacy Statement on or presented via this website at any time without further notification. The latest update is dated April 2018. We shall always process your personal data in line with the Privacy Statement in force at the time your data is collected.
